Limited Use Label License for the Tol2 System

This material (“ORIGINAL MATERIAL”) contains the Tol2 system, which is covered by patents (issued and pending) owned by the National Institute of Genetics (NIG/ROIS) Japan and other third parties. NIG/ROIS retains such rights to the Tol2 system in any derivative materials made by the RECIPIENT.

The distribution of the ORIGINAL MATERIAL by Addgene does not grant any license, express or implied, under any of NIG/ROIS’s patent rights. Any use of the Tol2 system except for internal academic research requires a license from NIG/ROIS. NIG/ROIS will not be liable to RECIPIENT for any loss, claim or demand made by RECIPIENT, or made against RECIPIENT by any other party, due to or arising from the use of the Tol2 system by RECIPIENT, except to the extent permitted by law when caused by the gross negligence or willful misconduct of NIG/ROIS.

NIG/ROIS MAKES NO REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE USE OF THE MATERIAL WILL NOT INFRINGE ANY PATENT, COPYRIGHT, TRADEMARK OR OTHER PROPRIETARY RIGHT.
