Lucia® Luciferase Limited Use Label License

BY USE OF THIS PRODUCT, RECIPIENT AGREES TO THE TERMS OF THIS LIMITED USE LABEL LICENSE.
This plasmid contains a Lucia® secreted luciferase proteins owned by InvivoGen. Lucia® luciferase is the subject of one or more issued and pending patents including U.S. Patent Nos. US8435777B1 and corresponding foreign patent claims. Lucia® luciferase requires the use of QUANTI-Luc™ assay reagent to quantitatively measure its activity.
“Product” shall mean and include this plasmid, its derivatives and any part of the forgoing material (whether or not included in any other material).

“Commercial Use” shall mean: (i) the transfer, sale and/or resale of all or part of the Product (whether or not such Product are resold for use in research), (ii) the use of the Product for manufacture purposes, (iii) the use of the Product for any development uses (such as, but not limited to, drug discovery, screening, drug development), (iv) the use of the Product for any quality control, release, or quality assurance assays including food and environmental testing or release assay, and/or (v) the provision of services, information or data using the Product.

Purchaser shall only use the Product for internal academic research use; no transfer nor any Commercial Use of the Product is allowed. No other use of this product or derivatives is authorized without the prior express written consent of InvivoGen. No modifications to the protein coding sequence of the Lucia® gene may be made without the express written permission of InvivoGen.

Notwithstanding the above, Recipient may deposit plasmids derived from this plasmid to Addgene for other academic and non-profit institutions for Non-Commercial Use.

InvivoGen MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING FOR MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH REGARD TO THE PRODUCT.
